Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ShieldBrief (the “Service”), operated by HexWarden Labs LLC, a Colorado limited liability company (“Company,” “we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Nature of the Service

ShieldBrief is an automated website accessibility monitoring and remediation-guidance service. The Service runs automated scans of URLs you submit and generates reports identifying potential violations of the Web Content Accessibility Guidelines (WCAG) 2.1, along with AI-generated remediation suggestions.

SHIELDBRIEF DOES NOT PROVIDE LEGAL ADVICE. REPORTS, REMEDIATION SUGGESTIONS, DASHBOARDS, AND ANY OTHER OUTPUT OF THE SERVICE ARE NOT LEGAL ADVICE AND DO NOT CREATE AN ATTORNEY-CLIENT RELATIONSHIP. You should consult qualified legal counsel regarding your obligations under the Americans with Disabilities Act (ADA), Section 508, state accessibility laws, or any other applicable law.

SHIELDBRIEF DOES NOT GUARANTEE ADA, WCAG, OR ANY OTHER FORM OF ACCESSIBILITY COMPLIANCE. Automated accessibility testing detects only a subset of potential issues — the open-source scanning engines we use (including axe-core) publicly state that automated testing can identify approximately 57% of WCAG violations. Comprehensive conformance requires manual review by qualified accessibility professionals and testing with assistive technology users. The Service is one input into your accessibility program, not a substitute for it.

3. Authorization to Scan

By submitting a URL to the Service, you represent and warrant that (a) you own or control the website, or (b) you have received authorization from the owner to request automated accessibility testing of the URL. You are solely responsible for any URL you submit. The Service performs only publicly accessible HTTP requests and does not attempt to access authenticated or non-public areas of a website.

4. AI-Generated Remediation Content

Some output of the Service is produced by large language models. Code and text generated by these models may contain errors, omissions, or incorrect assumptions about your platform, theme, or business logic. You are solely responsible for reviewing, testing, and validating any code or recommendations before deploying them.

5. Accounts and Subscriptions

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • Paid subscriptions renew automatically at the interval and price displayed at checkout unless cancelled before the next renewal.
  • We may modify pricing with at least 30 days' notice prior to the next renewal.
  • We may suspend or terminate accounts that abuse the Service, including automated scraping, attempts to scan URLs you do not own or control, or excessive request rates designed to bypass rate limits.

6. Acceptable Use

You agree not to:

  • Submit URLs you do not own or have authorization to scan.
  • Use the Service to conduct security testing, vulnerability scanning, or denial-of-service attacks.
  • Reverse-engineer, scrape, or attempt to extract the underlying scan engines or AI prompts.
  • Resell or redistribute reports without a reseller agreement.
  • Use the Service to harass, defame, or make false claims against any third party.

7. Intellectual Property

Report formats, dashboards, prompts, scoring methodology (“ShieldScore”), design, and software are owned by HexWarden Labs LLC. You retain ownership of the URLs and content you submit. You grant us a limited license to process that content for the purpose of delivering the Service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT SCAN RESULTS WILL BE COMPLETE OR ACCURATE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HEXWARDEN LABS LLC AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless HexWarden Labs LLC from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from (a) your violation of these Terms, (b) your submission of URLs you did not have the right to submit, or (c) your reliance on Service output without qualified human review.

11. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Colorado.

12. Changes

We may update these Terms from time to time. Material changes will be communicated via the Service or email. Continued use after the effective date constitutes acceptance of the revised Terms.
